§ 1. General

The General Terms and Conditions set out below govern the rights and obligations between 'smarthomefactory GmbH' and its customers. By placing an order, i.e. making a purchase, the customer automatically accepts these terms. Any deviations are only valid if confirmed by us in writing.

§ 2. Purchase on account

MF Group / POWERPAY, as an external payment service provider, offers the payment method "Purchase on account". With the individual invoice, you can simply settle your online purchase by invoice. Should you choose not to make a payment within the specified timeframe, you will subsequently receive a monthly invoice with an order summary in the following month.

Upon conclusion of the purchase contract, POWERPAY assumes the resulting invoice claim and handles the corresponding payment arrangements. When purchasing on account, you accept the terms and conditions of POWERPAY in addition to our own terms and conditions. (powerpay.ch/de/agb).

§ 3. Delivery

As standard, we only ship to addresses within Switzerland and Liechtenstein. All products that we have in stock in our warehouse are marked as such on the product page.

Should an item be out of stock, which is indicated on the product page, delivery may take several weeks. The customer has the right to cancel the order at any time, provided it has not yet been dispatched.

§ 4. Conclusion of Contract

The buyer undertakes to place the order in accordance with the terms and conditions stated on the website. Any errors in an order must be reported to smarthomefactory GmbH immediately. By making a purchase, the buyer agrees to the product information provided.

§ 5. Offers and prices

All offers and prices on the website are non-binding and subject to change. We reserve the right to correct errors or make changes to the goods and prices. Value added tax is included in all prices stated on the website.

§ 6. Returns/Right of withdrawal

In principle, a right of return applies within thirty calendar days of the date of purchase. In the event of a return, the goods must be in their original condition and unopened; otherwise, there is no entitlement to return the goods or withdraw from the purchase contract. The goods must be returned to smarthomefactory GmbH. The customer shall bear the costs of the return shipment, unless otherwise agreed in writing. Should the goods be defective, the buyer is entitled to a replacement or rescission of the contract.

§ 7. Data Protection

All data will be treated confidentially and will not be passed on to third parties. The customer agrees that their personal data may be stored and processed electronically within the scope of the business relationship. It is noted that data collected in accordance with this provision is collected and processed exclusively for the purposes of service provision, in particular for order processing and accounting. Data is transmitted in encrypted form. No liability can be accepted for the security of data transmitted via the internet.

§ 8. Warranty

The manufacturer's warranty applies to every item sold. Beyond this, for a maximum of two years from the date of purchase, smarthomefactory GmbH must be contacted. It is available for the statutory warranty period.

§ 9. Registered office

This website is operated by smarthomefactory GmbH, with its registered office in Uster, ZH. The company is registered in the Commercial Register of the Canton of Zurich under number CH-440.4.017.026-3. The exclusive place of jurisdiction is ZH-8610 Uster. Swiss law applies exclusively.

§ 10. Severability clause and validity of the Terms and Conditions

By placing an order, the customer accepts these Terms and Conditions. Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced immediately by the relevant statutory provision. Verbal agreements require written confirmation to be valid.
